Taking A New Job? Know Your Rights Before You Sign A Contract!

Getting a job and maintaining yourself in that job are two different things. You get a job; any job you get because you need to pay your bills. But once you start working and get your life on track you start seeing things with a different perspective. Maybe you don’t like your job anymore but sadly you already signed a contract and you cannot get out of it for another two years or atleast  don’t know how to.

A scenario and situation no one wants to be in for sure. But accidents do happen and unless you have safety air bags and insurance, you are in trouble. So what or rather who is going to be your safety bag in times of need? Who will come to your rescue? Answer- your lawyer!

Hire a lawyer or at least talk to one when you are in trouble. Its always advisable to get legal help before signing a job contract or anything in general actually. There are a lot of lawyers in Hong Kong that exclusively deal with employment problems and if you look closely, you can find firms that only take employees as clients and never employers. So you can be sure that the firm will only have your interests and concerns in mind and will be forever loyal to you.

But make sure that you hire someone who is well versed in Hong Kong’s labour lawas well as employment law. Your lawyer has to know everything that can help you in safeguarding your job, money and even employability. Because let’s say your employer fires you one day without any warning. What will you do? You did not do anything wrong. But still got fired. Well, first thing you do is you get a lawyer or at least get legal help. You need to get your rightful termination payments and you may even have to end up suing your employer if things don’t go smoothly. So get a good lawyer.

Or maybe let’s say you are too good at your job and other firms want to steal you away. One makes you an offer you can’t resist. So you decide to resign and work for the competition. All well and good so far? But it’s a possibility that your boss won’t like you leaving to work for his competitor. He may stop your last salary or your final bonus or he may not return your caution money of there was any. Troubles!!

In addition to this, before leaving you must talk to a lawyer about the consequences your resigning might have. Like you need to know if there are any restrictions on you when you leave such as non-compete, non-dealing, non-solicitation when you take your new job. Or your employer may claw back any share incentives that you were to receive.

A lot of things can go wrong when you get a job or leave a job and even when you are doing your job. You have to be cautious. Hire a lawyer or take legal advice whenever you are trying to make a decision.
