According to the Internal Revenue Service, since 1993, all foreign students holding F (student), J (public expense), and M (tourism) visas, or those holding J (visit), Q (exchange) visas Foreign scholars, regardless of whether they have a job or income, as long as they are temporarily residing in the United States, must submit a Personal Data Sheet (Form 8843) to the IRS and file a federal tax return 1040NR (US Nonresident Alien Income Tax Return).

International students in the United States for less than five years:
Have income: fill in forms 1040-NR and 8843
No income: be sure to fill out Form 8843

In the past, the relationship between tax reporting and international students involved only those international students who work in the United States (such as teaching assistants, research assistants, etc.) or have other income (such as scholarships); for students who do not have work or income, there is no need to worry about tax reporting. Foreign students with income need to fill in Form 1040 or Form 1040NR. Those who meet the requirements can also apply for U.S. China Tax Treaty to reduce taxes.
