Tier 2 Sponsor Licence: Employing skilled workers from overseas

Tier 2 Sponsor Licence is a permission given by the Home Office, that must be obtained by the company to employ skilled workers from overseas. The license was established by the UKVI (UK Visas and Immigration) to check if the company is eligible for employing talented overseas workers in the UK.

The company should obtain the license and make a job offer for Non-EEA nationals before they can come or remain in the UK for work.

Requirements for a Sponsor Licence application

• UK company should be a genuine organisation operating lawfully in the UK;

• The company should be capable of carrying out sponsor duties and evidencing compliance in an appropriate time frame and manner;

• The company should offer genuine employment that meets the required skill level and appropriate rates of pay.

To prove that UK company is a genuine organisation that operates lawfully in the UK, the company will need to submit the documents mentioned below:

· Certificate of Incorporation

· Latest Business Bank Statements 

· Hierarchy Chart of the Company

· Lease Agreement of the Commercial Property

· Company Tax Return CT620

· Latest Audited Annual Accounts

· CT600 tax return and the CT603

· Other Documents

By looking at the background and history of the company, the UKVI will assess whether the company is honest, dependable, and reliable. Human recruitment practises also will be examined to make sure that the company is able to the sponsorship duties.

Obtaining Sponsor Licence

1. Document preparation

UK Company should collect all relevant original or naturized copies of documents within company departments. 

2. Mock Audit

As part of the assessment, UKVI may visit their business premises. The company should be prepared for HR procedures inspection and employee interviews.

3. Sponsor Licence Application

The company can apply for a sponsor licence online, the submission will need to be printed for posting it to the UKVI, alongside all other relevant documents. The documents will be received by UKVI within 5 working days of the date on which the online application form is submitted. Most sponsor licence applications are processed within 8 weeks. 

4. Approval and Validation

The company will be granted an A-rated sponsor licence, which will allow starting assigning Certificates of Sponsorship to migrants. The appointed person within a company will be given the Sponsor Management System access (an online portal where they can manage their licence).
