Court Dispute Resolution and the Singapore International Commerce Court

Posted by shanekabuttler on March 27th, 2015

Singapore has fast emerged as one of the top most reliable venue for those who seek neutral court dispute resolution. Why Singapore is seen as an independent neutral venue is because of many favorable factors. The Singapore Law Academy consists of a strong, capable and developed judicial system. It is also ranked around the world as one of the top 5 countries in the World Corruption Perception Index. Also, in Singapore, the International Arbitration Act defined by the Singapore Law Academy is based on the UNCITRAL Model Law.

The Singapore International Arbitration Center has also grown in the last few years and today has become a recognized center that handles domestic as well as international arbitration.

The Singapore International Commerce Court

Commercial cases in Singapore have been handled through court dispute resolution. The Singapore international commerce court has been mulled as an ideal authority that can rule on cases that relate to commerce and other cases which might not be entirely suited for arbitration. The SICC will be responsible for handling all international dispute resolution cases.

Commercial cases that have little or no relation with the country of Singapore will be directed to the SICC for recourse procedures. Entities who are parties to international disputes can approach the SICC if they have previously agreed to include the SICC in future disputes for resolution. This can be done by including the SICC in business contracts as an authority that has jurisdiction over disputes. Alternatively, the SICC will also handle cases that have been directed to it by the Singapore High Court.

SICC for International Court Dispute Resolution

The Singapore International Commerce Court will function as an arm of the Supreme Court of Singapore but will have a distinct code consisting of its own rules and directions for practice. These will be included in the Rules of Court in Singapore. The judges who will preside over matters in the SICC will also be chosen from the existing benches of the Singapore Supreme Court and other associate judges working over there.

There also may be a Foreign Associate Judge whose appointment will be made by the Chief Justice of the Singapore Supreme Court. The Foreign Associate Judge will be a person of relevant experience and qualification who will function along with the rest of the judges chosen from the Supreme Court. The parties involved in dispute can request the hearings to be conducted in private, which is a feature of court dispute resolution followed in Singapore.
