NSW 491 Visa Requirements

Subclass 491 is a state nominated temporary visa for 5 years with pathway to permanent residency subject to meeting the criteria of new visa Subclass 191.

Subclass 491 visa allows you

  • Stay in Australia for 5 years
  • Live, work and study in a designated regional area of Australia
  • Apply for permanent residency after 3 years from the time 491 visa was granted
You must be nominated by a State or Territory or sponsored by an eligible relative. In addition, you must have an occupation on the relevant skilled occupation list and skill assessment for that occupation. You can’t apply or lodge 491 visa Australia application, you must have received an invitation and meet the point test.

NSW criteria for 491 as per today’s information.

NSW subclass 491 criteria is focused on people working in regional NSW. There are three different way someone could meet 491 nomination requirements:
  • Living and working in regional NSW
  • Recently completed study in regional NSW
  • Living and working outside of regional NSW

Three ways you can meet NSW 491 Visa Requirements

Your nominated occupation (e.g. Cook, Chef Accountant etc.) must be on nominated regions occupation list and you must have a positive skill assessment in your occupation. Now, question arises that what is this nominating/participating region? There are 13 participating regions within NSW and all of them have their own occupation lists. These participating regions are called RDA (Regional Development Australia) offices. The RDA offices will accept and process the nomination applications.
  • Central Coast
  • Central West
  • Far South Coast
  • Far West
  • Hunter
  • Illawarra
  • Mid North Coast
  • Northern Inland
  • Northern Rivers
  • Orana
  • Riverina
  • Southern Inland (including Murray region)
  • Sydney
You must be living in regional NSW for 12 month and have been working in your nominated occupation for 12 months.
  • You have completed a study related to your nominated occupation in designated regional area of NSW and the duration of the study is 24 months minimum. The college or university must be in designated regional NSW.
  • Living and working outside of regional NSW This stream is for people who are not living or working in designated regional NSW and meet one of the following criteria for subclass 491 NSW nomination:
  • Have a job offer in your nominated occupation (which is on a participating regions occupation list) for 12 months full time (35 hours per week) employment from an employer located in designated regional NSW.
  • Have five years of experience in your nominated occupation which is the list of participating regions.
  • Have a immediate family member living in designated regional NSW for the last 24 months. The family member must meet some requirements to sponsor you.
So, in a nutshell NSW is focusing on applicants who work or study in regional NSW or if their immediate family members are settled in regional area and they are willing to sponsor. The Government’s policy is to encourage people to move to regional Australia.
