RULES AND REGULATION OF AIT ARMS

1.It is prohibited to have a weapon or ammunition of categories II and III on hand. View here more information about this.

2.The first paragraph does not apply to persons who hold:

a. A leave as referred to in, of the Act, insofar as this leave extends; or

b. A hunting license as referred to in the Nature Conservation Act , with regard to weapons and ammunition of category III intended for hunting and management and damage control, which are described in the hunting license.

3. Our Minister may, by regulation, grant an exemption from the prohibition in paragraph 1 for weapons or ammunition of category III with regard to hunters and sport shooters who have their permanent residence or residence outside the Netherlands.

4. Our Minister may lay down rules with regard to the persons referred to in the second paragraph with regard to: a.

a. Medical fitness and skill in handling weapons;

b. The required knowledge of weapons; and

c. The maximum number of weapons they are allowed to have on hand.

5. Persons who have not yet reached the age of eighteen are prohibited from possessing a weapon of category IV.

6. By regulation, Our Minister may grant an exemption from the prohibition of the fifth paragraph in the context of sports practiced in a club or recreational activities designated by Our Minister in companies established for that purpose in which weapons are carried, 

 

OTHER FEATURES OF AIT ARMS

1. Permission for the possession of a weapon and ammunition is granted by the police chief, exclusively for weapons and ammunition belonging to category III.

2. Leave is granted if:

a. A reasonable interest claims the granting of the leave;

b. The applicant cannot pose a threat to himself, to public order or to safety;

c. The applicant has reached the age of at least eighteen years, except for members of a shooting club.

It may be determined by order in council in which cases there is a reasonable interest, as referred to in part a.

3. The interest for which the leave was granted is described in the leave.

4. Leave is valid for a maximum of one year and can be extended if the requirements for granting it are still met.

5. If the applicant who has no permanent residence or residence in the Netherlands is a resident of one of the other Member States of the European Communities, Our Minister shall notify that Member State of the granting of a leave as referred to in the first paragraph. , when the leave relates to weapons or ammunition, the possession of which is subject to a license in that Member State.

6. By way of derogation from the first paragraph, leave is not granted for a firearm as referred to in Category A, part 8, in Annex I of the Directive.

The order referred to in the third paragraph is given in writing, unless this is not possible due to urgency. In that case, the order will be put in writing as soon as possible. Investigating officers as well as other persons designated for this purpose by Our Minister are authorized to examine a person who is present at an airport designated by regulation of Our Minister, at all times by his clothing and the packaging of goods, including travel luggage, as well as his means of transport. . Our Minister shall only designate an airport in accordance with paragraph 5 if, in his opinion, this is necessary with a view to safety.
