Medical Marijuana Dispensaries - dispensary Requirements

There are two different categories that apply to those who wish to open medical marijuana clinics in the state of California. The first category are those who have applied for a Medical Marijuana Patient License (MPL) and are awaiting their approval. The second category of applicants are those who have been approved but are not yet licensed. If you fall in the second category, you need to go through an inspection before you can start selling or growing medical marijuana. It is important that you fully understand the dispensary Requirements before you submit your application.

A valid application does not mean that you have all the right to sell or cultivate any form of marijuana for profit. It means that you are allowed to participate in the State regulated system for providing medical marijuana to those who are seriously ill with debilitating medical conditions. The State has set a schedule of criteria for those who apply for a Medical Marijuana Patient License (MPL). There are a total of fourteen different forms that must be completed and signed by the prospective dispensary Manager before the license is issued. If you do not adhere to the City of Sacramento's dispensary Requirements for each of the forms, you may be disqualified from obtaining your patient license.

The City of Sacramento enacts the dispensary requirements at the beginning of the new year. Once the new year begins, new licenses will be available and all applicants must meet the City's dispensary requirements in order to get their licenses. Each time you change your location, you must notify the City in writing so they can re-evaluate your location. However, if you decide to move again after having obtained your new MMPR license, you must notify the City fourteen days in advance.

When you first obtain your permit, you must register with the city and pay the required tax. Once you have registered, you can now submit all the requisite paperwork and applications for your marijuana products to the local tax agency. All applications and paperwork must be completed and signed by the prospective dispensary Manager. In addition, each time you sell or distribute marijuana products in your facility, you are responsible to pay taxes on those items. Failure to pay those taxes can result in fines and charges.

Each time you open a dispensary in the City of Sacramento, you must maintain an inventory. This inventory must be comprised of all items that are for sale or distribution and all records pertaining to that inventory. If a distributor or retailer fails to maintain his inventory for fourteen days, he is required to repay all penalties and interest charges. If after a reasonable amount of time the distributor fails to make payment, he must notify the city authorities within forty-five days. Failure to make payment results in fines and charges as well.

One important distinction between a dispensary and a cultivator is that a dispensary is solely devoted to the sale of medical marijuana. While a cultivator is exclusively committed to the cultivation of medical marijuana. While both require an active membership, a dispensary may require a medical marijuana patient license (or MMJ) but does not require an active cultivation license. A cultivator, on the other hand, must obtain both a cultivation license and a retail marijuana patient license (or MMJ).

Some of the state and local regulations regarding medical marijuana dispensaries may vary. For example, some municipalities do not allow for outdoor growing, whereas others do. Furthermore, some municipalities prohibit employees of the dispensary from participating in any activity that would interfere with their employment (e.g., employees engaged in collecting money for the dispensary or transporting marijuana across state lines). Therefore, if you are considering opening a dispensary in a particular city or county, make sure that the regulations meet your needs before you get started.

Medical marijuana dispensaries are rapidly expanding across the United States. Although most of them are considered to be completely legal, operating one yourself comes with its own set of responsibilities. It is important to understand the requirements that each state requires to operate a dispensary before you start one. A good idea to start out is to contact a local attorney who practices in the field to gain more information about the laws in your area.
