Boundary dispute costs teacher a fortune

Boundary disputes are extremely complex areas of law that can take a long time to resolve, state Curry Popeck,Harrow Solicitors. They can be ruinously expensive too, as illustrated by this case where an argument over boundary proved extremely costly for a teacher.

The teacher had put up a fence along what she thought was the boundary of her property, to which her neighbours did not agree.

In order to erect the fence the teacher was obliged to apply for planning permission, however, she omitted to do this. The difference of opinion over where the boundary lay was evident early on when her neighbours marked out a line inside the line she considered marked the edge of her property. The physical difference was little more than 30cm.

The matters escalated and ended up in court. The judge decided upon a compromise, stating that the neighbours' view regarding the boundary line was correct but their application to have the fence removed was denied. The judge awarded the neighbours damages of £2,866, and a legal cost of approx £50,000 was awarded against the teacher.

The teacher’s objection to challenge the costs order was rejected as she lodged her complaint after the time limit for doing so had expired.

A boundary dispute is one of the most common causes of friction amongneighbours whooften seek help from solicitors to determine the correct boundary position. Experienced solicitors like Curry Popeck, solicitors in Harrow, will consider many factors, such as the title deeds, land registry information, physical features on the ground, like fences, walls, hedges, old photographs and witness evidence etc.

Despite all the evidence available, it is not always possible to precisely determine where the boundary line is, so it is always good to try to resolve a boundary dispute amicably.

However, if legal proceedings do become necessary, the court has the power to make an order determining the correct position of the boundary, as occurred in this case.

Most people think that the boundary between their property and their neighbour’s runs in a straight line down the middle of the land, however, it is not always the case. Always seek help of a good solicitor if nothing else works.
