Amid the recent resurgence in the COVID-19 situation across the UK (in both case numbers and the news headlines), you may feel that you barely know whether you are coming or going from work.

Nonetheless, if you are still working in the traditional office or another setting where you share a space with other workers, you might be interested to know what the law says about your right to vape at work in the UK.

Do the rules, for example, treat vaping as essentially the same as traditional cigarette smoking (which it absolutely isn\'t), or is a formal distinction made between the two?

It\'s a trickier question to answer than you might think

Much of the difficulty in being clear about where you are and aren\'t allowed to vape in the UK, lies in the fact that there isn\'t an official law in this country that bans the use of electronic cigarettes in any particular setting.

So, workplaces and other public places - such as airports, hospitals, pubs, restaurants and offices - have essentially been left to decide on their own policies.

And some of those workplaces, unfortunately for vapers, have chosen to effectively treat e-cigarettes as belonging to the same category as traditional cigarettes, by completely prohibiting their use indoors. This doesn\'t seem right to us, given that it actually is against the law in England to smoke in designated smoke-free premises, according to the Health Act 2006.

It is therefore sadly no great shock to hear of emerging discrimination against vapers in workplaces in the UK. As reported by the HullLive website and elsewhere, a recent study found that three quarters of vapers are apparently not permitted to vape at work, unless in dedicated smoking areas.

That would seem to be a direct contravention of guidance set out by Public Health England (now the UK Health Security Agency), which states that \"vapers should not be required to use the same space as smokers, as this could undermine their ability to quit smoking and stay smokefree, particularly among those most heavily addicted.\"

What about the situation when working from home?

One of the key benefits of home working, from the perspective of many vapers, might seem to be the freedom they gain to vape as they like over the course of the working day. And sure enough, it isn\'t illegal to vape inside your home.

However, if you rent your home, the situation might be more ambiguous. Nonetheless, a landlord might not be so concerned about the potential effect of you vaping on their property, if they know that e-cigarettes don\'t emit the same substances as traditional cigarettes - and therefore pose a lower risk of staining, odours and/or other harm to the property\'s fabric and/or contents.
