Creator sues Cloudflare and Thothub.tv for violating his copyright

Creator of OnlyFans Deniece "Niece" Waidhofer yesterday sued Thothub.tv for allegedly scraping and disseminating her images on its website. Waidhofer claims that her seminude and non-nude content has been "leaked" online after material intended for OnlyFans and Patreon consumption was shown on Thothub.tv, which reposts pay-walled adult content without charge to its 1 million members. Her lawsuit's 91-page complaint also claims RICO violations.

The complaint also names Cloudflare, the service provider for Thothub.tv, and a number of advertisers for adult entertainment as defendants. This action is being taken to prevent the distribution of [stolen] digital content by the members and co-conspirators of the pirate website Thothub. and to hold Thothub and its accomplices accountable for using Waidhofer's works and body for their own purposes, according to the lawsuit.

According to the lawsuit filed in federal court in Los Angeles, Waidhofer is a Texas-based lingerie and cosplay model who ranks in the top one percent of all creators on OnlyFans. According to the lawsuit, she has more than 1.9 million Instagram followers.

In the complaint, it was claimed that Thothub.tv advertises itself as "the home of daily free leaked nudes from the hottest OnlyFans and Patreon models" and "the biggest e-girl showcase in the world." According to the lawsuit, Thothub.tv generates significant revenue and profits for itself, its members, and its business partners by exploiting creators and their works and driving a ton of traffic to its website.

According to Waidhofer's claim, Thothub.tv has consistently ignored requests to take down copied content. Her lawsuit makes accusations of unfair competition, misappropriation of likeness, and direct, induced, and contributory copyright infringement. She also asserts that Cloudflare, Thothub.tv, and its adult advertisers operate as a RICO business.
