Hydel Power Projects & Tourism Objections Should Be Settled Through ADR Proceedi

These days there have been many such Hyde and other power projects which have been coming up. Also, there are many rejections and objections off late by the ministry of tourism. The objections have come up due to the over growing tensions with regards the health and environment and safety concerns. In the most recent case, the ministry of environment has acted very carelessly by ignoring the objections for the power projects raised by the ministry of tourism. It seems like Tourism and Power Projects cannot go hand in hand together.

Off late there have been discussions between the ministers and there are many chances that the Hyde power project may have to undergo some modifications. These modifications have been made keeping in view the concerns over environment and tourism which have been addressed of late. There has been case which has been filed against the project by the local stake holders. There has also been a demand to place on record the objections of the tourism and culture minister for the hydro project. The project was granted clearance in the year 2010.

Then later in the year 2012, there was a grant of wildlife clearance. The clearance was granted. It was granted by overruling all seven independent members of the National Board for Wildlife who opposed the move citing potential downstream impact on the dibru-saikhowa National Park in Assam. The forest clearance was also granted.

But off late dispute arose again in last month. The reasoning of the disputes are as follows, if the project is allowed, then it shall generate debris of which is likely to harm the holy site of Parashuram Kund. The beauty and glory both will be lost. The capital amounting to somewhere near about cores have already been spent for the building of the tourism complex at complex at Parashuram Kund and the construction of the dam “will be disastrous for Parashuram Kund, which is important from both cultural as well as tourism angle. But the ministry of environment is mum about this matter.

Later it was revealed through some sources that there has been no dispute and the issues have been resolved. Minor adjustments could be made and no damage shall be caused. But later it was found that the submissions of NGT did not provide for any modifications in the plan.

Forest clearance to the project is also under challenge and there is currently a stay on the project. The case should go in for the Arbitration and ADR Proceedings.   Also, it was later commented by the NGT that there was no nod or any assurance for the modifications. Appeals were dismissed against environmental clearance.
