Personal Injury Practice Trends for 2024

After the Covid-19 outbreak started more than two years ago and the courts were essentially forced to close for in-person appearances, personal injury accident law is starting to resume its regular course. Jury trials have been extremely uncommon during the last two years, and court appearances have mostly been conducted virtually via computers. Consequently, there is a backlog on the trial calendars in Nassau and Suffolk Counties. As a result, there has been an extended delay in the settlement of personal injury cases.

Has there been an acceleration in the trial and resolution of personal injury lawsuits on Long Island since the start of the pandemic? Thankfully, the courts are now operating and most appearances will be in person in the future. All participants, including attorneys and juries, must don masks, and social separation is being implemented. Nevertheless, the particular judge presiding over the court proceedings will decide exactly what steps need to be performed. All courtrooms will be required to maintain a social distance, but whether or not masks are required will depend on the particular judge presiding over personal injury cases.

A new system of required pre-trial mediation conferences has been implemented in New York State in an effort to clear the backlog of personal injury accident cases. Zoom or Microsoft Teams are still used to host these discussions virtually in order to reduce the number of people that must travel and to prevent courtroom congestion. All pre-trial conferences, however, will take place in person at the courthouse. The actual trials in instances involving auto accidents and other mishaps are resuming in the Suffolk and Nassau Counties courts.
