Understanding Criminal Law Cases

When a person does evil things or very bad things to another individual like stealing their property, murdering him or her, brutally beating him or her etc then the victim can file a lawsuit against the culprit in the Court. This type of case is then called a criminal case where a crime done to an individual or group of people or an organization is involved. Criminal Law Cases are those where laws safeguarding people or institutions from being wronged are broken and crimes are done.

Criminal law refers to a body of laws that are applicable to criminal acts. When an individual fails to adhere to a specific criminal statute, she or he commits a criminal act by breaking the criminal law. This body of laws is not same as the civil law, as criminal law penalties involve the forfeiture of one's rights and imprisonment. Conversely, civil laws are concerned with the resolution of legal controversies and involve money damages.

There are two types of criminal laws, namely Misdemeanors and Felonies. A misdemeanor is a lower level criminal offense, like for example a minor assaults, traffic offenses, or petty thefts. It has been observed that in most states in the USA, the penalty for the misdemeanor crime is typically one year or even less than that. However, felony crimes involve more serious offenses. Some examples of felonies include murder, manslaughter, drug smuggling or as such dealings, rape, sexual abuse, robbery, and arson. In every state in the U.S., felony crimes carry a penalty of one year or more, depending upon the seriousness of the crime committed nature of the offense and the jurisdiction where the felony crime was committed. It has to be remembered that every state has a different criminal law body which are never the same for any two state. Federal criminal law statutes are also there which apply to every state in the U.S. Two criminal law cases are never the same.

A criminal lawyer tries to prove that a crime has been done and the culprit gets punishment according to the seriousness of the crime done by him and the extent to which she or he has been involved in the crime. A person or persons against whom the lawsuit has been done in the Court, if proven guilty will get punished that can involve paying penalties, or community service or even spending years in prison or life imprisonment etc. Even death can be the punishment if the judge and jury members think that is the only punishment due to the cruelty of the crime committed by the criminal. Life imprisonment also means that the criminal has done something really very heinous and inhuman.

A criminal defense lawyer, hired by the person or organization against whom crime charges have been filled in the Court by the opponent party who is or are the victims, needs to strongly represent her or his client during the trial. Poor legal representation by criminal defense lawyer can be severe. Proper analysis of the case and legally protecting and guiding the client all through the criminal proceeding and trial process is done by criminal defense lawyer.
