Explain the role of negotiations in collective bargaining

Collective bargaining is a bargaining on the terms and conditions between the employer and the employee on a specified situation that is conflicting. Collective bargaining itself represents the bargaining and the negotiation process that takes place between the employee and employee relation. This process ensures that both the parties are agreeing to the mutual way in which the situation of the conflict could be handled and resolved. Negotiations play a very important role in collective bargaining as the situation would agree and must meet the requirements of both the parties involved in the collective bargaining. In the process of negotiation in collective bargaining, the involved parties have to set a goal or the target and even gather all the essential facts related to the situation or the conflicts. They have to then based on mutual consent develop a strategy whereby the issue or the problem could be resolved and attended to. Negotiations help in satisfying both the parties that are involved in the process of collective bargaining.

Assess the impact of negotiation strategy for a given situation.

Negotiation could be done in various forms and styles. It all depends on the way the negotiations are taken further. The person who is interacting with the parties has to first understand the situation and then take out a mutually agreed possible solution that could be adopted in order to resolve an issue. There are various techniques that are used for negotiations and become a strategy for resolving the conflicts:

  • Mediation and conciliation – This is the way in which the two conflicting parties will involve a third party to resolve their conflicts. This party will understand the situation and then without getting biased resolve the conflicts.
  • Finding of Facts – This also involves a neutral party that is 3rd party that will find out the necessary facts and information on why the conflict or the issue has arisen. These facts could then be used in order to really know the areas that are to be attended and resolved.
  • Arbitration of Interests – This will basically involve a panel that will comprise of one management and one neutral person that will hear to the problem and then based on a mutual agreement will resolve the problem or the conflict.

Conflicts are bound to happen but with the appropriate and effective strategy and negotiation process, it could easily be resolved and there is a greater role that negotiations play in the process of collective bargaining.

Conflicts and their resolution should be done as per the process of collective bargaining and the involvement of negotiations in the process.
