An Overview of CFR 40 and CFR 46

The Code of Federal Regulations (CFR) is an annual codification of rules, general and permanent both, published in the federal register (the official journal of the federal government of the United States) by the Federal Government’s departments and agencies. Divided into 50 titles, the code of federal regulations throws light on myriad areas subject to federal regulation.

Each title is further subdivided into chapters that are assigned to departments or agencies issuing regulations related to that broad subject area. Following that, each chapter is disintegrated into parts and each part into sections; section is the fundamental unit of CFR.

The prime objective of CFR is to offer an official and a complete text of regulations in a single publication. This is, in turn, helps people, ones who are expected to know the regulations, gain an access to a comprehensive and convenient reference.

40 CFR: Protection of Environment

The title 40 of the code of federal regulations was created by the Environmental Protection Agency (EPA). Many topics have been covered under this title, including air quality programs, water quality programs, pesticide programs, radiation protection programs, ocean dumping policies, solid waste policies, the Superfund based on the Emergency Planning and Right to Know Act, effluent guidelines and standards, sewage sludge policies, energy policies, toxic substances policies and air pollution controls.

46 CFR: Shipping

This title is the portion of the CFR that monitors shipping within the United States for the United States Coast Guard, the United States Marine Commission and the United States Maritime Administration. CFR 46 has been divided into 9 volumes and 599 parts, where each part signifies different regulations.

While Volume 1 encloses the procedure applicable to the general public, seamen, uninspected and tank vessels and merchant officers in detail, Whereas, Volume 2 include load lines, documentation & measurement of vessels, and general provisions. Next, volume 3 covers entire passenger vessels operating in the US and volume 4 covers vessels like mobile offshore drilling units, small passenger vessels, and miscellaneous vessels. All the dangerous cargo have been covered under the volume 5 of CFR 46.

In addition, there are two more volumes in CFR 46, namely volume 6 and volume 7. Volume 6 encloses information in regards to equipment, construction and materials: specifications and approval. Nautical schools, small passenger vessels, oceanographic research vessels and a host of health and safety standards and lifesaving applications is covered under the volume 7.
