What is Logo?

  • A small design or symbol adopted by any organization or business to identify its products, uniform, vehicles, etc. globally or worldwide is called Logo.
    With the surge of globalization logo registration has acquired quintessential role in our economy.
  • A company logo reflects its brand which distinguish describes the company name with a symbol, an image or creative font patterns. 
  • It can be explained as the visual icons that give an exceptional recognition aspect to a product or business and also give immediate visual identification of an organization which consecutively creates branding. 
  • Once the Logo is registered in the name of a business or any organization the same cannot be claim by others. 
  • Once the logo is registered the same can be used by the registered user for a certain period of time as may specified in the act and the same can be renewed on the expiry of the specified time period. 
  • Hence, it is necessary to protect it by filing an application for trademark in order to avoid infringement of the same.

What is the procedure of logo registration?

  • Conduct an online logo search online at iprindia.com to check the availability if the logo has not been registered by anyone else.
  • Filing of application for logo registration of logo in TM-A online/ physically to the Registrar of Trademark along with requisite fees as may be applicable from time to time.
  • Upon filing of application, the Registrar shall examine the application and issue a particular application number where the status of the same can be checked on online portal www.ipindia.gov.in.
  • If the Registrar consider the mark as a distinctive Logo or after the removal of the objections, if any, raised by the Registrar he may cause the application to be advertised in Trademark journal.
  • If no opposition to the Logo is filed within 90 days from the date of publication, Registrar registers the logo and allot a logo registration number in the name of the applicant (Business user or Organization).
  • Registrar issues Trademark registration certificate in favour of the applicant and the same can be used by the applicant as a registered user.
