Posted by Manowar Hossain Pranto on May 10th, 2018

Our solicitors deal with Criminal Injury Compensation Authority claims on a risk free no win no fee basis. Our clients never pay any charges unless the claim is settled successfully. We operate the no win no fee scheme otherwise known as a conditional fee agreement. No legal charge is payable unless the legal case is won and the client obtains an award of compensation. In the event that the legal claim is lost there is no charge made to the client.

Victims of Violent Crime

The Criminal Injury Compensation Authority Solicitor is responsible for administering a fund which pays compensation to the victims of violent crime for mental trauma, physical injuries and financial losses stemming from those injuries. The degree of the trauma and the injury sustained will be used to determine the settlement value on a tariff band basis. Any injury sustained that makes it necessary to visit a doctor at least twice and carries a minimum recovery period of at least 6 weeks will qualify for an award.

CICB Parameters

If the incident is not reported to the police immediately then it may not qualify for an award. A claim can be made up to two years following the incident. The CICB will take into account, among other things, the victim's behaviour preceding, during and following the incident. Also any prior convictions for violent offences which are unspent will be taken into account. Even if the assailant is not convicted of any violent crime, an award may still be made. In cases of family violence, compensation will only be awarded providing the guilty party does not benefit from such compensation.

County Court Compensation Claims

Although the county court provides a means to sue an attacker for damages, it is never guaranteed that the damages awarded will be paid to the victim. By going through the CICB you can be sure that any payment will be paid early and securely.

Northern Ireland Criminal Injuries Compensation Scheme (CICS) 2002 : Northern Ireland has its own tariff scheme to compensate victims of violent crime which was introduced in 2002. The scheme operates by assigning each type of injury a set tariff value. The Agency must clearly state reasons for denial or reduction of awards. The new scheme provides enhanced allowances for the psychological effects of bereavement. Claimants with criminal records are not absolutely precluded from receiving compensation, although there may be reduction or denial of an award. Victims of sexual abuse during their childhood, prior to May 1, 2002, may now also file claims.
