Ohio Says Hemp CBD is Illegal !

Cleveland, Ohio – Hemp based CBD which you can currently find online or at your local health store has been deemed illegal by Ohio State regulators.

On Wednesday August 29, 2018 the Ohio State Board of Pharmacy issued guidance on cbd oil derived from the hemp plant or cannabis plant. The State regulation says only approved dispensary in the State of Ohio can sell the cbd oil, with the State’s first dispensary month’s away this is putting users of cbd oil in a bind.

Issuing the guidance the State Regulators want all products containing cbd oil to comply with the states medical marijuana program, including going under lab testing. Currently none of the 4 labs that will issue provisional approval licenses for the cbd products are currently up and running.

Pharmacy board gave this guidance after a Ohio dispensary that is currently licensed ask if they can sell cbd oil in stores as seen in many grocery stores throughout the state. Ali Simon from the board said “ no”.

Simon said Ohio law defining marijuana as most parts including the resin, stalks and fiber of the plant. They classify cbd derived from industrial hemp, which under the federal farm act 2014 as containing less then .03 percent thc legal to sell in the United States.

After speaking some consumers about this decision has left many outraged, since cbd produces no thc has alleviated many these consumers inflammation, depression along with other ailments.

                                                                                       

So is Hemp Legal in Ohio?

CBD Gummies, CBD Vape Oil, CBD Cartridges, Oils, Soaps and Soda have been sold under the guidance of the 2014 Farm bill, which allows states hemp programs which also involves research in the plant.

In December 2016 the DEA clarified any substance including hemp still falls under the Schedule 1 substance like marijuana is illegal. The 9th Circuit Court of Appeals dismissed lawsuit against the DEA. But the court also in it’s opinion sided with the farm bill over the dea.

The FDA recently approved 2 pharmaceutical drugs that contain cbd for epilepsy and seizures.   

So what happens Next

Ohio Pharmacy board was not aware of any arrests or seizures of people who currently order cbd online or stores who are currently carrying the products.

In February, 2 business in the city of Lancaster where asked to stop selling the products and the inventory was confiscated.

As the legal battle rages between the states and cbd industry many patients looking for cbd can find safe comfort in buying online as the easiest and the safest way to get cbd in states that might not allow the sale of the products.
