Licenses Required for Production of Dairy Products

Wanting to start a production unit of dairy products in India? Before commencing operations, you need to get few mandatory registrations/licenses in place –

  1. Units involved in the production of dairy products can register as a One Person Company, a Limited Liability Partnership or a Private Limited Company.
  2. Apply for registration of the Trademark of the entity to protect the brand name from misuse.
  3. Get the GST registration done online. It would be mandatory to register if the annual turnover of the entity is expected to be more than Rs. 20 lakh or if the dairy products are to be sold across states within the country.
  4. Apply and obtain the MSME Udyog Aadhaar number.
  5. Factory License from the local governing authority so as to reduce risk and implementation of Safety and Health Management Systems in the premises.
  6. No objection certificate from the Pollution Control Board
  7. Certificates from Weight & Measurements
  8. Water Analysis report from a recognized laboratory
  9. Obtain BIS Certification from the Bureau of Indian Standards – though optional it is a good marketing strategy for the products to bear this certification as it’s an assurance of quality.
  10. Get the Food License from FSSAI.

FSSAI License/Registration - A dairy unit that can process more than 50,000 liters of liquid milk per day or 2500 million tons of solid milk per annum needs to apply for the central FSSAI license from the Central licensing authority.  For a unit involved in the production of dairy products that are equipped to process about 501 to 50,000 liters per day liquid milk or more than 2.5 million tons to 2500 million tons of milk solids per annum needs to get the state license to start and continue operations.

Both the licenses can be applied online at the Food Licensing and Registration System (FLRS). It is important to submit the Form-B, duly completed and signed by the authorized signatory or the owner/partners. For a milk processing unit, the owners need to submit the layout plan of the processing unit along with a detailed list of machinery and equipment installed at the unit. Chemical and bacteriological analysis report of water that is used to be as an ingredient from a recognized health laboratory need to be submitted too along with the Form. Another mandatory document that the dairy unit needs to submit is the source of milk or procurement plan for milk including the location of milk collection centers etc.

The units producing dairy products need to comply with the following parameters as per the checklist provided by FSSAI:-

  1. The FSSAI License needs to be displayed at a prominent location within the premises.
  2. The premises should have adequate working space and have designs in place for cleaning and prevent entry of dirt, dust, and pests.
  3. The internal structures and fittings should be of non-toxic and impermeable materials.
  4. The floors to be non-slippery and have slopping at requisite places.
  5. Doors and window need to be fitted properly to prevent entry of pests.
  6. Provision of adequate ventilation within the premises.
  7. Use of potable water that meets the standards of IS: 10500.
  8. Raw milk receiving dock is raised with sides to prevent contamination.
  9. The separate facility should be available for heat-treated milk and milk products.
  10. The milk and other raw materials that are received should be inspected before doing so.
  11. The temperature of raw milk received from bulk chilling centers should be 5 degrees centigrade or below.
