The WCIRB in its most recent public filing has proposed payroll limitations to a number of classifications. While this is contained in the filing for the 2019 Pure Premium Rates and USRP, these changes are proposed to be effective January 1, 2020. The classifications identified for payroll limitations in 2020 are: 8859 - COMPUTER PROGRAMMING OR SOFTWARE DEVELOPMENT – all employees – including Clerical Office Employees and Outside Salespersons
8820 - LAW FIRMS – all employees – including Outside Salespersons and Clerical Office Employees 8743 - MORTGAGE BROKERS – no direct lending 7607 - VIDEO POST-PRODUCTION – computer or electronic – all employees – including Clerical Office Employees and Outside Salespersons This change will result in a significant impact on audit. All employees will need to be looked at to see if they exceed the payroll maximum. Additionally, the rule as constructed provides that the maximum shall be pro-rated based on the number of weeks worked. This can be quite time consuming as you not only need to identify the employees that exceed the maximum but also verify the employment period for those who are below the maximum.
