Consequences of criminal records

Committing a crime and being convicted does not only imply a penalty of rights or a fine. It also involves the loading of criminal records and an exhaustive police record.

These criminal records also involve deprivations of opportunity. 

1. Those convicted who have extinguished their criminal responsibility have the right to obtain from the Ministry of Justice, ex officio or at the request of a party, the cancellation of their criminal records with the help of criminal record removal services, prior report of the judge or sentencing court.

2. For the recognition of this right will be indispensable requirements:

- Have satisfied the civil responsibilities arising from the infraction, except in cases of insolvency declared by the judge or sentencing court, unless the inmate's economic situation has improved.

The following deadlines have elapsed, without committing a crime again: 6 months for minor penalties, 2 years for penalties not exceeding 12 months and those imposed for reckless crimes, 3 years for the remaining less serious penalties, and 5 for serious penalties.

3. These deadlines will be counted from the day after the one in which the sentence is extinguished, but if this occurs through conditional remission, the term, once the final remission is obtained will be computed by reverting it to the day following the one in which it was left. The penalty is completed if this benefit has not been enjoyed. In this case, it will be taken as the initial date for the calculation of the duration of the sentence, the day following the granting of the suspension.

4. The inscriptions of criminal records in the different Sections of the Central Registry of Punished and Rebels will not be public. During its validity, only certifications will be issued with the limitations and guarantees provided in its specific regulations and in the cases established by the Law.
