Requirements for an EEA Derivative Residence Card

 

EEA Derivative Residence Card gives you the indirect right of residence under which your stay is dependent on the existing rights of another individual. In case you are the primary caregiver of someone who has the right to live in the UK or are the primary caregiver’s child then you can apply for this card. This card proves that you have the right to live and work in the UK. in case you are already living in the UK then you will not require derivative residence card but it can help you with these things:

  • To re-enter the country quickly after coming back from abroad visit.
  • To show the employers that you have permission to work in the UK
  • To show to the authorities that you are allowed to reside in the UK

You can apply for EU settlement scheme if you want to continue living in the country. If you are outside the UK then you cannot apply for derivative residence card but you can apply for EEA Family permit.

Requirements of derivative residence card:

List of required documents:

  • Your current passport or other travel documents
  • 2 passport-sized colored photos of you and other dependents included in the application
  • Birth Certificates and other documents that prove your relationship with the individual you are the child of or are the primary caregiver of
  • One passport-sized colored photograph of the person you are the child of or primary caregiver of

Requirements when applying as a primary caregiver:

  • Proof of present immigration like passport, birth certificate or adoption certificate
  • Proof that they are dependent on you
  • Proof that you live in the UK, like Bank statements, tenancy agreements or utility bills
  • Proof that the children are EEA nationals and are financially independent with complete health insurance.

Requirements when applying as a child of EEA National who leaves UK or stops working:

  • If you are studying in the UK then a letter from the college, university or school
  • If you were educated in the UK when your EEA parent was residing in the country then a letter from the educational institute along with tenancy agreement or utility bill from your parents.
  • Biometric information of non-EEA nationals
  • Proof that your EEA parent was working in the UK while you were in the UK like a letter from the employer or pay-slips
  • All the non-EEA nationals applying need to provide their biometric information

Children below 16 years of age must be accompanied by parents or guardians while applying. If the responsible adult is not the parent or guardian then he/she must be above 18 years of age.

Fees to apply for derivative residence card:

The fee to apply for the derivative residence card is 65 pounds per person along with 19.20 pounds for your biometric information.

Who can apply:

Direct Family members:

  • A civil partner or spouse
  • Child or grandchild under 21 years or a dependent
  • Dependent parents or grandparents

Extended family members:

  • Cousins
  • Brother or sister
  • Aunt or uncle
  • Niece or nephew
  • Any relative by marriage
  • Relatives like great-aunt, great-nephew or second cousin

If you want to get a derivative residence card then you must be one of the following:

  • Primary caregiver-child
  • The primary caregiver of someone who has the right to live in the UK
  • The child of Former EEA worker or if you are studying at any educational institute
