Request for cancellation of personal data from the Police file l Pardons.org

Police records will be subject to cancellation, in accordance with the following rules:

Cancellation at the office: The deadlines for prescribing criminal liability established in the Criminal Code will be taken into account.
Cancellation at the request of a party: It will be decreed in those cases in which the Judicial Authority issues a conviction against the applicant, being mandatory to carry out the previous cancellation of the criminal record derived from the said sentence, in the Central Registry of Punished and Rebels of the Ministry of Justice.

Cancellation: It will proceed in all cases in which the resolution adopted by the Judicial Authority is of acquittal, dismissal or file.
The cancellation will also be decreed in the cases in which, even if the conviction is passed, 5 years have elapsed, counting from the date of final remission of the penalty imposed, without incorporating new unfavorable data into the applicant's personal file.

The formal requirements of the rectification and cancellation rights required are:

- Application instance in which the complete affiliation data, the current address and in the case that it is intended to cancel the police record and/or partial cancellation thereof, the specific antecedent referred to in the request.

- In the case of exercising the right of rectification exclusively, it will be necessary to specify what data it refers to and the correction to which it is to be made, accompanied by supporting documentation of the request.

- A copy of valid passport, unless consent has been given to verify identity data. 

- Certificate of the corresponding Judicial Authorities, certifying the resolution adopted regarding the antecedent or background that you wish to cancel.

- In the case of administrative sanctions, certification proving the effective payment of the fine or being exempt from responsibility for the facts that motivated the background.

- In case of acting through a legal representative, power of specific representation for the exercise of the right of cancellation.
- Authorization to obtain the certificate of criminal records in the Registry of Penalties of the Ministry of Justice.
