The dui vs dwi dilemma

Posted by hellensmith on April 16th, 2012

The difference between dui and dwi remains unclear for many persons, for the two terms are most of the times used interchangeably and broadly refer to the same situation. Actually, when studying matters in detail, it can be noticed that we can speak of dui vs dwi laws only in a couple of states that draw a distinction between the two terms and the penalties associated with each of the two offences.

As already mentioned, there is  a difference between dui and dwi only in a couple of states  that treat driving under the influence and driving while intoxicated as distinct offences for which distinct penalties apply. In Texas, for instance, we can talk about dui vs dwi, rather than about dui equals dwi, for driving under the influence is considered a misdemeanor that is usually punished by applying a fine, whereas driving while intoxicated is a criminal offense punishable by jail for a period of at least 72 hours. The same applies for the state of Maryland, where the difference between dui and dwi is regulated in the criminal code of this state, which sets very strict penalties for both offences. Other states, such as Colorado, replace the dwi from the dui vs dwi equation with dwai, which stands for driving while ability impaired, but, in this particular case, dui is considered to be the more severe offence.

Anyhow, irrespective of the difference between dui and dwi, which exists only in a limited number of states and which basically occurs at the level of the penalties that apply for dui and dwi offences, the fact remain that the laws with regard to driving under the influence or driving while intoxicated with alcohol, drugs or any other controlled substance which impairs our normal use of our physical and mental faculties are very strict, being designed primarily at preventing injuries and deaths caused by dui accidents and at determining people to think twice before getting behind the wheel after consuming too much alcohol or other substances that affect our driving ability. Thus, although it is important to be aware of the difference between dui and dwi, if any, it is far important not to drive when intoxicated, so as not to endanger innocent lives.

Furthermore, there are many voices who find the dui vs dwi opposition confusing and persons who find themselves facing dui/dwi charges are usually recommended to resort to a criminal lawyer with vast knowledge of the applicable regulations, for only a true connoisseur of the dui/dwi or dui vs dwi laws in effect in a particular state is capable of bringing light into the matter. All in all, maybe it is best to mention, once again, that USA citizens are not allowed to drive under the influence, when intoxicated or while ability impaired and that, irrespective of the associated terminological and legal nuances, the wisest and safest thing to do is to treasure life and not to drive when we do not feel up to the task.
