Divorce Act Changes (Bill C-78) and how it may affect your case!

As of July 1, 2020, the changes that have been made to the Divorce Act, a Federal Act, shall be coming into place. It is important when dealing with Family Law matters that clients are aware of changes and understand them. The major changes deal with and include (but may not be limited to):

  • Terminology of “custody” and “access” to such things as “parenting”, “decision-making”, “parenting time” and “contact Orders”;
  • Expansion and further factors to the “best interest of the child”;
  • Family violence factors;
  • Mobility and relocation issues; and,
  • Jurisdiction issues.

It is our firm’s mandate that we inform clients of their rights and obligations under the laws that govern Ontario and Canada as a whole. However, the issues are always case-by-case. It is important to speak to a lawyer when determining the effect of these changes on your personal situation.
